Sherin Mathews, who was adopted by an Indian-American couple in 2016, died in October last year allegedly from choking after her adoptive father "physically assisted" her with drinking milk.
A spokesman for the Dallas County Medical Examiner said the body of Sherin was released on Saturday but did not say who has custody of the body.
Sherin went missing on October 7 and her body was found on Sunday from a culvert in suburban Dallas, Texas.
Mathews, who was arrested on Monday, is now charged with causing injury to a child which carries a maximum penalty of life in prison.
"We are deeply concerned about the missing child. Indian Embassy in US is actively involved and they keep me informed," Sushma Swaraj tweeted
